In Texas, three companies have business licenses from the state to grow marijuana that contains CBD and small amounts of THC. Only people who have intractable epilepsy and two doctors’ recommendations can buy the cannabis oil to use as medicine. 

But other cannabis products have caused head-scratching among government officials who have to decide how, or whether, to regulate them. Last spring, the Department of State Health Services considered a proposal that would require inspectors to detain all food or other products that have CBD added to them, even if they didn’t contain THC. It later backed away from the policy.

After the farm bill passed, the commissioner of the Food and Drug Administration reiterated that the agency has not approved cannabis-related food, beverages or dietary supplements and warned about potential enforcement. 

D’Angelo said Neiman Marcus turned to its legal team for guidance. And like all of its beauty products, she said, employees tested each item before approving it for the stores. She said the products have been warmly received since they hit stores in mid-December.
